Terms of Service

1. Definitions

For the purpose of this agreement:

  • "Company" refers to Pulse Realty (Pty) Ltd, including its program "StreetScout".
  • "Partners" refer to third-party business partners, affiliates, associates, and vetted service providers.
  • "User" refers to the individual registering to provide information.
  • "Lead" refers to the data (addresses, owner details, or buyer referrals) submitted by a User.
  • "Services" refers to lead generation, referral, and data brokerage activities.

2. Conditions of Use and Broadened Scope

By using streetscout.co.za (or lead-the-way.co.za), you certify that you have read and agree to these terms. StreetScout grants access only to those who accept these terms. While the focus is real estate, the Services encompass lead generation for finance, insurance, and consumer activities.

3. Age Restriction

You must be at least 18 years of age and legally capable of entering into binding contracts to participate.

4. Referral Fees & Payments

The Company provides a tiered remuneration system for Users who submit valid Leads:

  • Address Only (R100 + R1,750): Paid for a verified property address where the User identifies a potential seller. This is subject to the address being unique and not already in our system. A further R1,750 is paid upon the successful registration of the property sale.
  • Seller Lead (R250 + R1,750): R250 is paid when a property owner is successfully contacted and signs a mandate. A further R1,750 is paid upon the successful registration of the property sale.
  • Buyer Referral (R500): Paid only upon the successful registration of a property transfer where the referred buyer was the effective cause of the sale.

For a seller lead to be successful and trigger the initial referral fee, it must satisfy the following conditions:

  • Validation: The lead must be valid, contactable, and unique, meaning it is not already present in the company database.
  • Explicit Consent: The property owner must provide explicit, informed consent to have their property listed for sale specifically through a StreetScout-affiliated agency.
  • Mandate Achievement: Remuneration is tied to the owner signing a mandate with the agency.

A further R1,750 bonus is paid upon the successful registration of the property sale.

Withholding Rights: The Company reserves the right, at its sole discretion, to reject Leads, withhold payments, or terminate accounts if it suspects fraud (e.g., submitting public data as private knowledge), misrepresentation, or a breach of the consent warranties.

5. User Accounts & Security

You are responsible for the accuracy of your registration and the security of your account. You are liable for all activities under your account.

6. Lead Submission & Warranty of Consent

You EXPRESSLY WARRANT that you have obtained prior, explicit, and informed consent from any third party (Sellers or Buyers) whose personal information you submit. You agree to fully indemnify the Company and its Partners against any legal claims or POPIA-related fines arising from a breach of this warranty.

7. Intellectual Property

All materials and services provided are the property of the Company. You agree not to reproduce or redistribute our intellectual property.

8. Limitation of Liability

To the maximum extent permitted by South African Law, the Company is not liable for indirect or consequential damages arising from your use of the system or the actions of third-party Partners.

9. Applicable Law & Disputes

The laws of the Republic of South Africa govern these terms. Disputes shall be handled by the competent South African courts.

10. Payments

All payments are made on a Wednesday or Friday, or any other day as communicated by StreetScout. StreetScout will not be able to make any additional payments if a User provided incorrect payment details.
